In Ontario, the Private Security and Investigative Services Branch (PSISB) of the Ministry of Community Safety and Correctional Services (MCSCS) is responsible for the licensing of private investigators, and others in related areas like security guards. The Private Security and Investigative Services Act, 2005, defines the legal and regulatory framework for the industry.


Rules of the trade for investigators include always carrying their licence when working, showing that licence if asked and following a code of conduct.


“This regulation defines what kind of behaviour is appropriate or inappropriate for private investigators to display while they are working. Private investigators will find that respecting the Code of Conduct is, in most cases, a matter of common sense – private investigators are expected to treat members of the public in a respectful and professional manner.”


Knowing and complying with these rules should be a basic requirement when looking for the provision of private security and investigative services. Other conditions for having a licence include a clean criminal record and being at least 18 years old.


Penalties for contravening the act could involve a fine of up to $25,000 and or imprisonment. “As such, it is crucial that private investigators comply with all aspects of the PSISA and its regulations to avoid the possibility of being named in a complaint or facing charges.” It’s a serious business requiring serious skills and people.
